U.T. Administration of Dadra & Nagar Haveli has constituted an advisory committee consisting of official and Non- Official members to suggest measures for prevention of child prostitution and programme for card protection and rehabilitation of victims vide Notification No. 8-8/ICDS/51 dated 06.07.1994.
U.T. Administration of Dadra and Nagar Haveli has constituted a Complaints Committee for the redressal of sexual harassment of women worker at working place vide order No. 1-5/(A)(69)98-ADM/ 139 dated 28.01.2003.
The U.T. Administration of Dadra and Nagar Haveli is very small tribal territory. No case of Trafficking of women and children for commercial sexual Exploitation has been reported till date as per records. As, regards child prostitution including girl child. Prostitution, this administration has constituted an advisory committee consisting of official members to suggest measures for eradicating child prostitution, for the care, protection and rehabilitation of victims. As per suggestions made by the committee the police authorities were suitably instructed to deploy special police for constant local intelligence in industrial areas in their vicinity to detect child prostitution and illegal activities. The committee has not received any complaints of sexual harassment at working place till date.

The Committee shall ensure time bound treatment of complaints and will involve a third party, either NGO or other body who is familiar with the issue of sexual harassment.The complaint committee shall make an annual report to the Adm. Of the complaints and action taken by them. The head of offices and person in charge will also report on compliance with the guidelines issued by vide Notification IEO/LAW/DNH/70/97 dt. 20.03.98 including on the report of the Complaints committee to the Administration.

MADHYA PRADESH


1. I state that issues raised in the writ petition are matters of great public importance and which needs attention of all concerned. The government of M.P. is also taking necessary steps for effectively implementing the Action Plan prepared by the Government of India. For implementing the Action Plan in the state one coordinating committee has been constituted by the state government under the Chairmanship of Chief Secretary. Last meeting of the said committee took place on 21.1.03, wherein the Home Secretary informed that all districts of M.P> have been notified under the Suppression of Immoral and Illegal trafficking Act and special Training Cell are being formed for the training of the police officers.
2. Information has also been sent to the Government of India on 9.12.02 as required in the prescribed Performa.
3. In M.P. ?Bachhra?, ?Bedia? and ?Sansi? communities are involved in the prostitution since traditionally. The State Government has conducted detailed survey and sociological study of the social, economical and cultural status of these communities and a detailed action plan has been sent to the Government of India for financial assistance but the assistance has not been sanctioned till the date and a letter written for this purpose dated 12.06.03 is Annexed.
4. That one advisory Board has been constituted on 10.12.1998, known as ?Bedia, Bachhra and Sansi Jati Vikas Mandal?.
5. For development of these communities the state government has formed one Action plan known as ?Jabali? and in Madhya Pradesh at present nine voluntary organisations are running Ashram Schools wherein about 40 children are being kept. In each Ashram School there is a capacity of about 50 children. That there are three Short stay homes run by the Government namely which are as under-

· Rajkiya Mahila Uddhar Grih, Indore
· Shaskiya Alpkaleen Avas Grih, Rewa
· Shaskiya Alpkaleen Avas Grih, Jabalpur
Recently the state government has increased the scholarship of the children from Rs. 250/- to Rs. 350/- for boys and Rs. 360/- for girls by order dated 9.7.2003, who are being kept in the Ashram Schools.

6. That the Home Department has also taken action for implementing the Action Plan of the Government of India. In each police station child welfare officer has been appointed and special juvenile police cell has been constituted under the Juvenile Justice Act 1986. that the State government by notification published in the Madhya Pradesh Gazette dated 17.5.2000 has declared prostitution prohibited area specified in column 3 of the said notification and the non-official advisory body has also been formed to help special police officers. I crave to refer the Madhya Pradesh gazette dated 17.5.2000.
7. That the social welfare board has also taken necessary action for implementing the action plan and the department is coordinating with the other departments and giving assistance and the department has started giving protection to children kept in children homes and they are being given professional training for rehabilitation purposes so that they can earn their on livelihood. The department gives assistance to non government organisations, who impart training to such children including medical care.

Manipur

That it is quite pertinent to state that this state does not have any established red light area or high traffic/supply zone. There is no such report of prostitution, child prostitute and children of prostitute in the state as yet. However, the State Government will abide the plan of action ti combat trafficking and commercial sexual exploitation of women and children, department of Women & child development, Ministry of human resource Development, Government of India. That the State Government have taken the following actions in relation to the Immoral traffic (Prevention) Act. 1956. All the Supritendents of Police of all districts in the State of Manipur have been appointed as Special Police Officers for dealing with offences committed under this act in respect of areas covered by their respective jurisdiction by issuing an order under No. 2/12(6)/2002-H(1) dated 19th April, 2003. That, the State government by and in the name of Governor of Manipur issued another order under No. 2/12/2002-H(II) to constitute an advisory body in each district of Manipur State in pursuance of Sub- Section 3(b) of Section 13 of the Immoral traffic Prevention Act 1956.
That, the State government has one Juvenile home for accommodation, care and counseling child victim for their re-integration in the society. The said home is run by the State Social Welfare Department, government of Manipur. That, the State Government is assuring to implement all the recommendation of the Committee which are within its power to implement and falls under the state and concurrent list of the Constitution of India. That in view of the facts and action taken by the state government in the preceding paragraphs there is no instance of intentional negligence by the State Government in discharging its duties under the law. That, the State government will abide by all the directions issued by the Honorable court and it is clearly stated that the state authorities did not receive specific reports on Prostitution, Child prostitutes and Children of prostitutes yet.``

Tripura



That it is submitted that no case of trafficking and sexual exploitation of women & children under Immoral Trafficking (Prevention) Act, 1965 has been registered in the State of Tripura. That it is submitted that the notification of Special Police Officer and the notification for constitution of an Advisory Body under Section 13(3) (b) of immoral trafficking (Prevention) Act, 1956 is yet to be issued by the Government of Tripura.

Meghalaya



That though child prostitution is not in existence in Meghalaya the Government of Meghalaya has constituted an Advisory Committee on 7.5.1994 to suggest measures for eradication of child prostitution and programme for care , protection and rehabilitation of the victims. That the meeting of the Advisory Committee which was constituted on 7-6-94 was held on 17-6.96. That government of Meghalaya has set up a coordination Committee on 3.07.01 to review the situation and the progress made in implementation of the National Plan of Action in combating trafficking and sexual Exploitation of women and children. Annexure III NOTE: The Annexure consists of copy of order for constitution of Coordination Committee dated 3rd July 2001 and Minutes of the Meeting on Plan of Action to combat trafficking and sexual exploitation of women and children date 14.11.2001

. The Meeting decides that
· The problem of Prostitution was negligible so far.
· Only one case under ITPA in past 5 years.
· No problem of child prostitution.
· Strategy to be appointed to create a reliable and relevant data base information, by conducting study and surveys.
· For rescue and rehabilitation , to provide women with income generation schemes and economic security by involving NGO?s in setting rehabilitation centres
· Maximum utilization of three state run homes for training for self employment at Shillong, Jowai & Tura.
· Proper counseling, shelter, medical and psychological treatment and reintegration with humane treatment at centres to be taken up and run by NGO?s through Shelter Homes, Short Stay Homes and protective homes, financed by state.
· Separate court to deal cases of Prostitution and sexual exploitation involving women magistrates and counsels.
· Re ? Notification of special Police officer under ITPA to be done since it was not done since 1994.

1. Prevention



· Long term training cum income generation projects taken up under IRDP, Development of women and Children in Rural areas, CAPART schemes, khadi and village Industries Commission schemes, STEP, Socio- Economic programmes, NORAD, Rashtriya Mahila Kosh, Prime Minister Rojgar yojana, Swaran Jayanti Shahi Rojgar Yojana and other such existing schemes of Central/ States for women and child victims of prostitutions. · Stidies /surveys sponsored to create a reliable and relevant data base on the high supply areas, routes, destinations causes of commercial sexual exploitation, high risk groups, the exploiters, the magnitude of the problem. · Number of family educating counseling centre and short stay homes set up in highly supply areas. At present there is no specific programme for women and child victims of prostitutions, because Meghalaya does not have a specific red light Area. But with the problem arising the government has taken initiative in encouraging genuine NGO, to come forward with income generation projects proposals for victims.
1. Survey on the girl child labour in Meghalaya ?a socio- economic problem ? leading to expectation has been conducted by Impulse NGO Network under the sponsorship of save the Children India.
Action Research on Trafficking of Women and children sponsored by NHRC/UNIFEM is being carried out by Impulse NGO Network.

Based on research findings the state government will take initiatives to encourage NGO?S to set up the Home as per need base.
2. Number of Committees formed for the Protection of Rights of Women and Children at district, Block/ Mohalla level/ formation of watch dog committees/ community surveillance Groups /Neighborhood policing/ Village saksharta Samities etc.

II. Trafficking 1. Appointment of Anti ? Trafficking police Officers under ITP Act.23 Inspector of Police were appointed as Special Police Officer for the purpose of ITPA (Notification enclosed) Shri R.P. Agrawal, IPS DIG(CID) was appointed as NHRC State Nodal Officer on trafficking issues.
2. Issue of instruction to immigration officers/ block Police Authorities and local police in the transit areas for keeping a vigil on the entry of young girls in International Border States, whether help lines established for women through Short Stay Homes, Ngo?s

Effort is being made to mobilise NGO?s to coordinate with the concerned authorities to look into this issue.
Awareness Generation and Social Mobilisation
Awareness generation campaigns taken up on gender discrimination/ projection of prostitutes images of girl children and women through print/ electronic media.
Awareness generation Campaign is being taken up by the NGOs in collaboration with State government.
Health Care services

1. Providing of health care services, whether health cards are being issued to women and child victims. Setting up of the health care centres in or near red light areas by State government or NGOs with assistance from Central/ State government. Not yet implemented. however the matter will be examined with the concerned department.
2. Educational Campaigns about the risk of unprotected sex.Being organised by the NGOs in collaboration with Health Department and Meghalaya State Aids Control Society.
3. Setting up of separate shelter homes for women victims suffering from terminal stages of AIDS.
NIL. At present research is being conducted on this area.
Education and Child Care
1. Providing free and compulsory education to child victims/children women victims in Govt./ municipal schools.
Nil. Research report is yet to be submitted.
2. Steps taken to encourage that the name or consent of the father/ male guardian not to be insisted upon for the purpose of admission of children of prostitutes in any school or hostel.

State Level task force headed by the secretary will be constituted immediately however at present the department is networking with State Chapter Action against trafficking and Sexual exploitation of women and children (ATSEC) Maghalaya.
6. Steps taken to eliminate child pornography in all medias including prohibiting its possession. Awareness programme by NGOs is being organised. Rescue and rehabilitation
1. setting up of Rehabilitation centres for women and children to provide education, health, counseling, vocational training, guidance for recovery and rehabilitation of victim of prostitution. The NGOs have taken initiative in setting up of rehabilitation centres and recently one NGO have applied for financial assistance under the Scheme Swadhar. Three girls were rescued from Mumbai and were rehabilitated with the help of the Impulse NGO Network Shillong.
2. upgrading the services in remand, Juvenile, Protective, Correctional and Detitute homes to be manned by well qualified and specially trained and committed social workers. Matters will be examined for consideration.
3. Involvement of women?s organisations in monitoring of remand, protective and other homes. Nil.
May be considered for future action.
4. Action taken by state government with NGOs to provide proper shelter, travel arrangements, medical and psychological treatment and reintegration with humane treatment. Networking with State chapter ASTEC Meghalaya, (Impulse NGO Network) is carried out in providing proper shelter nd travel arrangements.
5. Setting up a system of coordination through inter country NGO networks for safe passage, rehabilitation and reintegration in their community , home countries for women and child victims from foreign countries.
